The Bombay High Court recently granted relief to a Bachelor of Homeopathic Medicine and Surgery (BHMS) graduate, who had challenged a Maharashtra Administrative Tribunal (MAT) order which did not allow him to appear for an exam for the posts of food safety officer and assistant commissioner of food.
The high court allowed him to file an application to Maharashtra Public Service Commission (MPSC), which will organise the exam on June 4 and asked the MPSC to accept the same and issue a hall ticket to the petitioner within 24 hours.
A division bench of then Chief Justice (now retired) R D Dhanuka and Justice G S Kulkarni on May 29 heard a plea by Dr Nitin Hiralal Shimpi challenging the MAT chairperson’s order that refused interim relief to him to appear for the exam.
The MAT had denied interim relief on the ground that the petitioner had filed the application belatedly.
In an order on March 29, in an original application filed by Dr Malakappa M Patil, a BAMS graduate, the MAT had directed the MPSC to make available an online application site where applicants could fill up the form and had clarified that any decision in the matter would be subject to the outcome of the original application before the panel.
